Hi, yes, the problem is, it is not conflicted by Phoca Gallery, because Phoca Gallery does't use z-index. So the only way to solve it or get more info is to see the templates developer site or joomla.org forum. I have tested some templates which had problems with the menu and they had problems with other parts of Joomla! system too. 
So the problem is, there is nothing to change in Phoca Galley as z-index is not used there
