Problem with two menu entries to the same albums

Hi
I'm running Joomla 1.5.9 and Phoca Gallery 2.2.4
We have a public menu which has a simple category view and piclens.
For members who are logged in I have setup a different menu option and through the parameters for that entry have allowed the download option. Since doing this, when a non logged in person selects the back icon to go back to the top level, they get an error saying they need to be logged in. However if they are two levels down, they can go back one level without an error message.
I've check directory permissions and .htaccess etc. and can see no difference.
It could just as easily be a Joomla issue. Has anyone else seen this or know of the resolution

Solved with an update to the latest version.
